Klife Terms of Use

These Terms of Use ("Terms") govern your access to and use of the KLife mobile application (the "App", the "Service"), provided by Hariss International Ltd ("the Company", "We", "Us", "Our"). By creating an account or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

You must be at least 18 years old to use the App. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Information you provide (including your display name and category) is self-entered and not independently verified by the Company.

KLife is a fitness-tracking application that allows you to record runs, walks, and other activities using Global Positioning System (GPS), view your activity history, and, during designated live events, appear on an event leaderboard alongside other participants who are using the App at the same time. Outside of live events, activity tracking is private to you and is not ranked or shared.

IMPORTANT - READ CAREFULLY.

The App is intended to help you track physical activity and is not a medical device. The App does not provide medical advice, and any information displayed (including step count, calorie estimates, distance, or pace) is for general informational purposes only and should not be relied upon as accurate for medical, diagnostic, or health-management decisions.

Before beginning any physical activity program, including participation in a running event, you should consult a physician or qualified healthcare provider, particularly if you have any pre-existing medical condition. You assume all risks associated with physical activity undertaken in connection with your use of the App, including risks of injury. The Company is not responsible for any injury, illness, or health consequence arising from your participation in any activity tracked through the App or any event you join.

The App relies on your device's GPS and network signal to estimate location, distance, and route. GPS accuracy can be affected by signal strength, device hardware, weather, and terrain, and may be reduced or interrupted, including during background tracking or periods without connectivity. Distance, pace, and leaderboard standings displayed by the App are estimates and are not official or verified results. The App is not intended for use in emergencies, and you should not rely on it for navigation or safety-critical purposes.

During a live event, your self-entered name, category, and activity data may be visible to other participants and viewers through the event leaderboard. Leaderboard standings reflect activity recorded through the App by users who chose to participate and are not official results of any third-party event organizer, timing system, or registration provider. The Company reserves the right to remove any entry it reasonably believes reflects inaccurate, fraudulent, or manipulated data (for example, location data reflecting an impossible speed or distance).

With your permission, the App may access location services and health/fitness data made available through Apple HealthKit or Google Health Connect. You may withdraw this permission at any time through your device settings, though doing so may limit App functionality. Health Data is used solely to provide App features and is handled as described in our Privacy Policy.

Subject to your compliance with these Terms, the Company grants you a limited, non-exclusive, non-transferable, revocable license to download and use the App on a device you own or control, solely for your personal, non-commercial use.

The App uses third-party services, including Apple, Google, mapping providers, and hosting infrastructure, to operate. These providers have their own terms and privacy practices, which are not controlled by the Company but which are expected to be in tandem with internationally recognised general principles of data protection.

The App, including its design, branding, and underlying software, is owned by the Company or its licensors and is protected by intellectual property laws. Nothing in these Terms grants you any right to use the Company's or any sponsor's trademarks or branding without prior written permission.

You may stop using the App and delete your account at any time. We may suspend or terminate your access to the App if we reasonably believe you have violated these Terms, engaged in fraudulent activity, or posed a risk to other users or the Service.

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT GPS OR HEALTH DATA WILL BE ACCURATE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, ARISING FROM YOUR USE OF THE APP OR PARTICIPATION IN ANY EVENT, INCLUDING ANY PERSONAL INJURY, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.

You agree to indemnify and hold harmless the Company, its affiliates, and sponsors from any claims, damages, or expenses arising from your use of the App, your violation of these Terms, or your participation in any event.

These Terms are governed by the laws of Uganda including any amendments thereto without regard to conflict of law principles. Any disputes arising from these Terms or use of the App shall be subjected to private mediation, failure of which the same shall be submitted to arbitration in accordance with Uganda's Arbitration and Conciliation Act Cap 5.

If you downloaded the App from the Apple App Store, the following additional terms apply and take precedence over any conflicting term above with respect to your use of the App on Apple devices:

We may update these Terms from time to time. Continued use of the App after changes take effect constitutes acceptance of the revised Terms. We will update the "Last updated" date above when changes are made.
